One of the sources for my
paper will be the book Supreme Power: Franklin Roosevelt vs. the
Supreme Court by Jeff
Shesol. In the book Shesol argues that Roosevelt lost the battle to “pack the
court” under the Judicial Procedures Reform Bill of 1937 due to discontent with
the American people and within his own party.
However, Shesol argues that
despite the defeat of his bill, Roosevelt was later able to gain the upper hand
in controlling the Supreme Court due to eventually appointing a majority of the
Justices on the bench. This book will be an important source in my paper and
will be useful in understanding how Roosevelt lost the battle to “pack the
